Following the running of Race 3, BNZ Rating 70, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr D M Walsh, alleging a breach of Rule 866 (1) (c) in that Mr Walsh "failed to ride his mount EDRERT fully out to the finish and was beaten out of 5th place by half a head".

Following the running of Race 3, BNZ Rating 70, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr D M Walsh, alleging a breach of Rule 866 (1) (c) in that Mr Walsh "failed to ride his mount EDRERT fully out to the finish and was beaten out of 5th place by half a head".
----Mr Walsh was present at the hearing of the information and admitted the breach which was found proved accordingly.
----Rule 866 (1) (c) provides as follows:
------(1) Every person commits a breach of this Rule who:
----(c) being the rider of a horse in a race fails to ride his horse out to the end of the race if there is a reasonable chance of it running into first, second, third, fourth, fifth or sixth place.
----Mr M R Davidson, Stipendiary Steward, showed a video replay of the concluding stages of the Race. He pointed out Mr Walsh riding EDRERT against the rail and KNOTS (J D Laking) out wider. Mr Walsh had suffered a bit of crowding and had been forced down to the rail. He then pushed his mount along but relaxed his ride three strides short of the post. KNOTS had claimed EDRERT right on the line – the official margin between 5th and 6th was a half head.
----Mr Walsh referred to the video and showed that he had come around another runner and had then suffered crowding from two horses on his outside – one eventually pulled off but the other kept coming in. He acknowledged that he had "sat up" but said that he was concentrating on the horse that had crossed him. He sat up to balance his mount to take the bend past the winning post. He said that he had been looking at the horse directly in front of him rather than at KNOTS finishing out wide.
----Mr Ching accepted that Mr Walsh had been hampered in the early part of the straight but he believed that he should have "pushed" his horse for another couple of strides in which case he would have had a reasonable chance of finishing 5th. Mr Ching informed the Committee that Mr Walsh had a clear record. He should also be given credit for his admission of the breach. Mr Ching advised the Committee that the stake for 5th placing in the Race was $225. Mr Ching recommended a fine of between $200 and $300.
----Following a deliberation, the Committee delivered the following oral decision:
--"In this case, Mr Walsh has pleaded guilty to the charge of failing to ride his mount EDRERT fully out to the finish in Race 4. EDRERT finished in 6th placing, the official margin between 5th and 6th being a half head. The Committee has viewed video replays of the final 200-300 metres of the Race and has listened to the submissions of Mr Ching and Mr Walsh. In determining penalty, the Committee has had regard to the following matters:
------1. Mr Walsh’s frank admission of the breach;
--2. Mr Walsh’s previous good record under this Rule;
--3. The explanation given to us by Mr Walsh;
--4. That the placings involved were 5th and 6th and that, therefore, there were minimum consequences to other parties. The Committee notes that the stake payable for 5th placing in the Race was $225; and
--5. Finally, the recommendation relating to penalty made by Mr Ching.
--Taking all of those matters into account, the Committee has decided that the appropriate penalty in this case is a fine of $250 and Mr Walsh is fined the sum of $250 accordingly."
