Following the running of Race 3, First Sovereign Trust Rating 70, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr R Stam, alleging a breach of Rule 871 (1) (d) (careless riding) in that Mr Stam "allowed his mount OOBLIX to shift outwards when not sufficiently clear causing DON BUCK (A M Mundy) to check near the 100 metres".

Following the running of Race 3, First Sovereign Trust Rating 70, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr R Stam, alleging a breach of Rule 871 (1) (d) (careless riding) in that Mr Stam "allowed his mount OOBLIX to shift outwards when not sufficiently clear causing DON BUCK (A M Mundy) to check near the 100 metres".

Mr Stam had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Mr Ching showed video replays of the final 200 metres of the Race. He pointed out Mr Stam one off the rails, following HULA WISH (R K Fraser), with DON BUCK on his outside. Mr Ching submitted that there was room for Miss Mundy to improve into the gap at that point. Mr Stam was "pushing" his horse and moved out into Miss Mundy’s line. Miss Mundy had told the Stewards that she could see Mr Stam coming and had checked her mount out of it. Mr Ching asserted that Mr Stam was definitely not clear when changing ground. Miss Mundy’s actions had mitigated the seriousness of the incident, Mr Ching said.

Mr Ching agreed with the Chairman that Mr Stam was barely one length clear when he angled his mount outwards.

Mr Ching informed the Committee that Mr Stam was to begin a 5-days’ suspension after this day’s racing – up to and including 29 January 2009 – imposed at Reefton on 7 January 2009. Mr Ching said that Mr Stam was a "Central Districts rider" but had come down to ride for a Canterbury trainer over the West Coast circuit.

Mr Ching outlined Mr Stam’s record which included four previous breaches of the careless riding Rule as follows:

Mr Ching submitted that the breach was in the "low to mid range". He said that the Stewards were seeking a term of suspension and recommended a term of suspension of between 4 and 6 days. Mr Stam was entitled to credit for his admission of the breach, Mr Ching said.

The Committee adjourned to deliberate on the matter of penalty. Prior to resumption of the hearing, the Chairman asked the Stewards if Mr Stam could be summoned to attend the hearing before the penalty was finalised. Mr Stam was then approached by one of the Stewards but reaffirmed his intention not to attend the hearing. The hearing continued in his absence.

In determining penalty, the Committee had regard to Mr Stam’s admission of the breach and to Mr Ching’s submission as to the degree of seriousness of the breach. In the Committee’s view, the seriousness of the breach was mid-range at best, and it agreed with Mr Ching that Miss Mundy’s defensive riding had significantly mitigated the seriousness of the incident. The Committee noted Mr Stam’s poor record of breaches of the careless riding Rule, this breach being his fifth in just over 9 months, and his second in a week. A deterrent penalty was called for in the circumstances.

The Committee did not have the benefit of hearing submissions on penalty from Mr Stam and, inparticular, as to what meetings he would be likely to be riding at after 29 January 2009 when his suspension from Reefton expired. The Committee noted Mr Ching’s submission that Mr Stam rode principally in the Central Districts of the North Island and had regard to this in fixing the term of suspension for the present breach.

Mr Stam’s jockey’s licence was suspended from 30 January 2009 to 18 February 2009, both dates inclusive – a period of 3 weeks.
