Stipendiary Steward Mr CJ Allison alleged that "with approximately 300m to run Mr AD Milne struck Mr AJ Suddaby with the whip."

Stipendiary Steward Mr Ydgren showed and explained the video evidence. He was situated in the tower and viewed this from the top of the straight. He did not see the incident but heard someone call, "you f??. c?." He did not know who said it. He said after the finish Mr Suddaby immediately complained to a gate steward and then to him (Mr Ydgren) when he arrived back at the gate. The video evidence was unclear and unhelpful.

Mr Suddaby said just after the 400 metre mark he was in the one-one and pushed Mr Milne four wide. He said Mr Milne called out, "You f??. c?" and hit him on the face. Mr Suddaby said Mr Milne said nothing else, but, he, Mr Suddaby, had another go at him verbally. He claimed he could see the whip coming across and it hit him on the face. He was struck only once. He showed a very small red mark on his chin area. He claimed he was shocked and moved out sharply as a result. He added, "I don?t drive like that for no reason."

Mr Milne said he was outside Mr Suddbay and driving aggressively. He gave his horse one and was "flat". He yelled at Mr Suddaby when he came out ? he did not know what he said ? he could see what was about to happen and again tapped his horse up. He said he had no chance after that. He said if he had hit his horse again it was only once and if he struck Mr Suddaby it would have been purely accidental.

Mr Allison summed up that this was obviously a serious allegation and that ?

Video evidence was extremely poor and Mr Ydgren saw nothing. He did hear the yelling but did not know who yelled.

The Chairman said he did believe Mr Suddaby might have been struck but could not find if he was that it was deliberately done.

The Chairman dismissed the charge against Mr Milne as he had little worthwhile video or first hand evidence that there was any intention for him to have done this and there is insubstantial evidence to confirm that Mr Suddaby was hit at all, although indeed he may have been.
