Accordingly Bruegel was declared to be a non-starter.

Facts:

Following the running of race 9 the Liquorland Gore Guineas. A request for a ruling was filed pursuant to rule 632. This was to determine if the starter's attendant was holding onto the horse Bruegel's ear when the start was effected denying a fair start to the horse.

Rule 632: if in the opinion of the judicial committee a horse does not finish in the first 3 placings was prevented from taking an eff

ctive part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord) the judicial committee may declare such a horse to be a non-starter.

Submissions for Decision:

Mr. M. Pitman the trainer of Bruegel explained to the committee that in the horse’s previous 3 starts he jumped well from the starting gates and raced handy to the pace. He stated the race was for a significant stake and the owners had incurred significant expenses. Mr. Pitman used the various video clips of the start, highlighting Bruegel who was drawn in barrier position 11 the outside barrier in this race.

Mr. Pitman stated Bruegel was one of the last horses to load into the barrier and he basically walked in “straight away”. Mr. Pitman then highlighted the starter’s attendant in the gate holding the horse’s ear screwing it and pushing its head to the side of the gate. The horse shoves its head one way as the gates open and then the horse jumps in the air and knuckles over, losing all chance.

Miss Bennett the rider of Bruegel stated that the horse “walked in good, stood there, and then leaned back a bit and then the starter's attendant grabbed Bruegel’s ear.”

Miss Bennett said in her opinion the horse was clearly denied a fair start, as he did not jump evenly with the rest of the field.

Mr. Jenkins who was one of the starter’s attendants said he got up beside Bruegel in the barrier and as he started to rear onto his hind quarters, Mr. Jenkins said he put his hands on the rein to stop the horse going over backwards.

Mr. Officer was the starter’s attendant behind the barriers. He stated the Bruegel was fractious and rearing up and that Mr. Jenkins was having a job to restrain it.

Mr. Officer stated that he did not know as to where Mr. Jenkins was holding Bruegel.

Mr. Pitman stated that none of the video clips highlighted Bruegel playing up and that in his opinion he was held by the ear and clearly denied a fair start.

Stipendiary Stewart Mr. M. Davidson was given the opportunity to give his opinion of the events that occurred.

Mr. Davidson stated that the video clip shows the starter’s attendant has a hold of the ear of Bruegel as the barriers open. It was up to the committee to determine in the interest of racing was Bruegel denied a fair start.

Reasons for Decision:

After viewing the video films the committee is clearly satisfied that the starter’s attendant has held the ear of Bruegel as the barriers have opened. Bruegel has turned his head sideways and jumped awkwardly nearly knuckling over.

Mr. Pitman’s summation of the events surrounding the incident and Miss Bennett’s evidence was accurate and compelling, both supporting the video films.
