Miss Black had admitted the breach and the charge was found proved.

Penalty:

Miss Black’s Apprentice Jockey’s Licence was suspended from the conclusion of racing on 24th May 2013 until the conclusion of racing on the 9th June 2013, incorporating four South Island racing dates.
 

Charge:

 Rule 638 provides as follows:

(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be: (d) careless.

Facts:

Following the running of Race 8, the AON INSURANCE BROKERS HANDICAP, an information was filed by Stipendiary Steward Mr J McLaughlin, against Licensed Apprentice Jockey Miss R Black, alleging a breach of Rule 638 (1) (d) in that Miss Black, as the rider of “Al Askan” in the race, that, “…near the 200m mark R Black permitted her mount Al Askan to shift ground when not in a position to do so hampering Irish Wit (C Johnson).”

Miss Black was present at the hearing and indicated that she admitted the breach.  She was assisted at the hearing by Mr M Henry, Licensed Trainer. 

Submissions for Decision:

Stipendiary Steward, Mr M Zarb, with the assistance of the Race Video, illustrated how Miss Black's mount “Al Askan” was near the rear of the field and on the inside of Irish Wit (C Johnson). He indicated that near the 200m mark Miss Black shifted outwards coming into contact with Irish Wit.

Mr McLaughlin stated that near the 200m mark Miss Black shifted outwards in an attempt to improve her position, and in doing so she allowed her mount to come into contact with Irish Wit. He said Mr Johnson was forced to take a hold to avoid the heels of forward runners to avoid a more serious incident.

Miss Black stated that when she made the move initially there was a gap to improve into where she thought she might get a run. She said she thought she could do a bit of “argy bargy” and secure a run. However, she admitted her mount was not clear of Mr Johnson when she came into contact with his mount.

Mr Henry had no submissions to make. 

Submissions for Penalty:

Mr McLaughlin told the committee that Miss Black had been suspended twice during the current season under the same Rule. She received three days at Tapanui in December 2012 and four days at a Wingatui Premier meeting in February 2013. He said the incident was in the mid range.

Ms Black requested a deferment for seven days to allow her to ride at Riccarton on the 24th May. She said she rode in the South Island only.
 

Reasons for Penalty:

Considering that Miss Black has had two previous suspensions this season a starting point of five days suspension was appropriate.

Miss Black’s early admission of the breach was taken into account along with Mr McLaughlin's submissions regarding Miss Black's co operation during the inquiry.

In setting an appropriate penalty the submissions from Miss Black and Mr McLaughlin have to be balanced against the fact that Miss Black has been suspended twice already this season. Credit of one day was given for her early admission of the breach of the Rule and also that she is an Apprentice Jockey.

Accordingly a suspension of four South Island racing days is an appropriate penalty. The penalty to be deferred until after the conclusion of racing at Riccarton on the 24th May, 2013.
