Accordingly I am satisfied that Heart Of Hearts was denied a fair start and her chances were materially prejudiced. Heart Of Hearts is declared a non runner in this event.
Facts:
Following the running of Race # 6, “JOHN BRICK MEMORIAL HANDICAP” a request for a Ruling was lodged by Stipendiary Steward Mr J McLaughlin. The request alleged that “...the barrier attendant had hold of Heart Of Hearts as the gate opened and the filly continued throughout the race with a lead attached.”
Rule 647 (1) provides as follows:
If, in the opinion of the Judicial Committee, a horse that does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord) the Judicial Committee may declare such horse to be a non runner.

Mr McLaughlin stated that Heart of Hearts (R Black) drew the outside barrier stall. The horse had to be led into the stall with a lead rope attached to the bridle. The barrier attendant was unable to release the lead rope before the starter released the field. The result was Heart Of Hearts raced throughout with the lead rope attached to its bridle. He said Miss Black had kept the horse near the rear of the field and shifted wide on the turn and into the straight to keep clear of other runners.
Ms Black stated she was able to hold onto the lead over the initial stages but the lead continued to flap around the horse’s legs throughout the running. She stated at no point was she in a position to fully ride her mount out to its full potential.
Reasons for Decision:
Clearly, the chances of Heart Of Hearts were affected from the outset. Miss Black made every effort after the start to secure the lead and keep clear of the body of the field during the running. However, at no point during the running was she able to effectively ride her mount out to its full potential.
