CHARGES:

At the conclusion of race 3 the Gore Plumbing Services Maiden an information 7493 (was lodged by Stipendiary Steward Mr M Davidson) under rule 638(1)(d) alleging that K Williams the rider of Gargamel permitted her mount to shift inwards when not clear causing Mangaroa Prince (A.Mundy) to check in the final 50metres of the race.

The rule reads a rider shall not ride a horse in a manner which the Judicial Committee considers to be careless

Miss Williams admitted the breach.

FACTS/SUBMISSIONS

--

Stipendiary Steward Mr Davidson showed the committee several video clips of the alleged incident highlighting the inward movement of Gargamel when not sufficiently clear causing Mangaroa Prince to be checked.

Miss Williams said her horse was having its first race day start and was very green. She also stated that the horse had run in and she had not reacted quickly enough.

--

DECISION:

--

The committee was satisfied a breach of the rule had occurred. Clearly Miss Williams allowed her mount to move inwards and had an error of judgment by not taking any corrective action resulting in Mangaroa Prince having to be checked.

SUBMISSION(s) ON PENALTY:

--

Mr Davidson stated that Miss Williams had an excellent riding record and had received only one suspension over the past twelve months. This suspension occurred in May 2010 and resulted in 3 days suspension,

Mr Davidson said he believed the interference was minimal and was at the very low end of the scale of carelessness.

--

Miss Williams wished the committee to take into consideration the seven day rule as she had firm riding engagements up to an including racing on Sunday the 17th October 2010

PENALTY:

--

Miss Williams was suspended for two South Island riding days. In fixing penalty the committee considered the breach of the rule to be at the lower end of the scale.  Consideration was also given to Miss Williams’s early admittance of the breach.

Miss Williams was suspended from the completion of racing on the 17th of October 2010 until the completion of racing on Saturday 23rd October 2010.
