At the conclusion of Race Ten, the Tokonui Tavern and Liquorland Gore Handicap (2000m) an information (5508) was lodged by Stipendiary Steward Mr M Davidson under Rule 638(2) alleging that Jockey J Todd made a celebratory gesture prior to the winning post when riding JARDENA (8).

At the conclusion of Race Ten, the Tokonui Tavern and Liquorland Gore Handicap (2000m) an information (5508) was lodged by Stipendiary Steward Mr M Davidson under Rule 638(2) alleging that Jockey J Todd made a celebratory gesture prior to the winning post when riding JARDENA (8).

The Rule states, “A rider shall not make a celebratory gesture prior to this horse passing the winning post.”

Mr Todd admitted a breach of the Rule.

--

 

--

Stipendiary Steward Mr M Williamson showed the Committee several video clips of the alleged incident highlighting Mr Todd’s gesture, about twenty metres from the winning post.

Mr Todd stated he thought he was closer to the winning post, and that he had got over excited riding his partners horse to win.

--

 

--

Mr Todd also stated that it was his third winning rid for the day, which added to the excitement.

--

The Committee upheld the breach of Rule 638(2).

--

Mr Davidson was requested to give submissions on penalty, stating that Mr Todd had not committed a breach under this Rule, and that he had admitted the breach on this occasion straight away, without delay.

--

Mr Todd did not offer any submission on penalty.

--

The Committee fined Mr Todd the sum of $100 taking into consideration, Mr Todd’s early admittance of the breach, his excellent riding record and the winning stake of the race, $4,063.
