Facts:
Mr Renault alleged that Mr Beck (BETTOR ENFORCE) breached rr 869(4), 6(b) and (c) in race 9, the MCDOWALL PAINTING & DECORATING GORE GRASS CUP, in that near the 1700 metres he shifted outwards which caused the improving SON OF LANA (Ms S Tomlinson) to be forced wider.
Rule 869(4) states:
No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.
While r 869(6) provides:
Subject to sub-rule (4) hereof:-
(a) horseman are permitted to move ground inwards or outwards at any stage of the race to improve their racing position;
(b) a horse making a forward movement during any race shall not be forced to race wider on the track;
(c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.
Mr Renault showed videos of the race in question. He identified Mr Beck racing midfield on the pylons with Ms Tomlinson trailing him one position further back. She commences a move and when the head of her horse is outside his sulky wheel Mr Beck shifts out. Ms Tomlinson is forced to race wider on the track. Mr Beck spots his mistake and attempts to shift back down but he is unable to do so as Mr Barclay has moved up and taken the space that Mr Beck had vacated.

Mr Renault produced Mr Beck’s record under this rule which showed no previous breach of the push out rule this season.
Reasons for Penalty:
The breach is accurately described by Mr Renault. We add GROOMSMAN (Mr Hunter), which was racing ahead of Mr Beck, had come off the pylons just a little earlier and it appears Mr Beck had decided to follow Mr Hunter but had left his move too late.
