The stipendiary steward Mr Allison laid an information after the conclusion of Race 10 alleging a breach of Rule 869(3)(b) in that Mr R Tither (WEE WILLAM) moved ground inwards when not sufficiently clear

The stipendiary steward Mr Allison laid an information after the conclusion of Race 10 alleging a breach of Rule 869(3)(b) in that Mr R Tither (WEE WILLAM) moved ground inwards when not sufficiently clear of MISTER CHEQUEBOOK (G Lee) with approx 400 metres to run.

Mr Tither admitted the breach and indicated he did not require the assistance of a senior driver. I thus find the charge proved.

Mr Knowles, stipendiary steward, demonstrated the incident on the videos. He said that with approximately 450 metres to race Mr Tither moved from the 3 wide line to 2 wide when not sufficiently clear of MISTER CHEQUEBOOK. Mr Lee had to take hold of his horse which was squeezed and broke briefly.

Mr Allison said the incident was at the lower end and could be dealt with by way of a fine. Mr Tither agreed with this. Mr Tither's record was produced which showed 2 breaches of the careless driving rule in the past 6 months.

It is accepted that the breach was at the lower end of the scale but nonetheless there were safety issues involved for both horse and driver. It is fortunate that Mr Lee was able to take hold of his horse, as many of the other horses were gaining momentum and preparing to mount their runs to the finish at the time. MISTER CHEQUEBOOK was tiring and thus its chances were not affected. However, had Mr Tither waited another 20 metres there would have been no problem as he now recognised. Taking into account the nature of the breach, Mr Tither's open and forthright admission of it, and his record, a fine of $275 is imposed and he is reminded of his obligations under the Rules of Harness Racing.
