Facts:
Following the running of race 2 The Knight Racing Stables Mobile Pace an information requesting a ruling under rule 213(1)(J) was filed by Mr T Robertson the Driver of FEAR XCHANGE to determine whether FEAR XCHANGE was denied a fair start.
Rule 213 provides as follows:
(1) A stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all of the following grounds:-
(i) If a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.
Submissions for Decision:
Mr Robertson told the Committee that his horse FEAR XCHANGE drew barrier fifteen and that he had to shift ground prior to the start to avoid the breaking ROCKING ROBYN (C Ferguson) , who drew barrier seven.
Mr Robertson stated that Mr Craig Ferguson had called out to him when his horse broke. Mr B Ward the official starter said he did not believe FEAR XCHANGE had been denied a fair start , as he believed Mr Robertson had plenty of time to avoid ROCKING ROBYN and that no contact had been made.
Mr Ydgren (Stipendiary Steward) stated that there may have been some slight interference when ROCKING ROBYN broke, but in his opinion the chances of FEAR XCHANGE had not been materially affected.
Reasons for Decision:
After having viewed the video replays of the start of Race 2 it was very clear that ROCKING ROBYN has broken prior to the mobile barrier release. Mr Robertson (FEAR XCHANGE) has trailed up in the second line and has momentarily been slightly affected by ROCKING ROBYN.
The Committee is satisfied that FEAR XCHANGE’S chances were not materially prejudiced or affected and believe that FEAR XCHANGE has received a fair start.
