Decision:
At the conclusion of Race 3, The Mataura Licensing Trust Fillies and Mares Mobile Pace, under Rule 869 (8) a protest was lodged (Information # 13928) by the Trainer and Driver of IMA LOCH, Mr A W Kyle, who was placed third by the judge, alleging that with approximately 400 metres to run, UNDER ENEMY FIRE, driven by M Williamson, shifted outwards onto IMA LOCH. The official margins being a head between first and second placings, and a length and a quarter back to third placing.

--Mr Kyle used a video clip of the alleged incident, stating that in his opinion, whilst moving his horse IMA LOCH forward into a challenging position, he was interfered with by UNDER ENEMY FIRE (M Williamson) who he believed moved out when not clear, and made contact with his horse. Mr Kyle said his horse lost about one and a half to two lengths in the incident.
--Mr Williamson said there was no contact made, and that Mr Kyle was behind his horse and had sufficient room to move out.
--Mr Gerken, trainer of UNDER ENEMY FIRE, maintained that the video clip showed no interference took place and that in his opinion Mr Kyle had every chance to improve his horse.
--Stipendiary Steward Mr McIntyre stated that in his opinion, Mr Williamson’s horse made a slow gradual movement into a space which he was entitled to be in, and that no contact had been made.
--DECISION
--The Committee dismissed the protest. In our opinion Mr Kyle had every chance to improve his horse, and no contact was made between UNDER ENEMY FIRE and IMA LOCH. Mr Williamson’s actions were slow and deliberate and did not hinder Mr Kyle’s horse’s progress forward.
