Facts:
Following the running of Race 7, the MATAURA LICENSING TRUST GORE TROTTING CUP DISCRETIONARY HANDICAP PACE, an information was filed by Stipendiary Steward, Mr C J Allison, against Licensed Open Horseman, Mr C J Thomas, alleging a breach of rule 869 (2) (a) in that Mr Thomas, the driver of RONGAHERE, used his whip excessively over the final 400 metres.
Submissions for Decision:
Mr Allison used video film to show where Mr Thomas was trailing at approx. the 400 metre mark. Mr Allison pointed out where Mr Thomas had struck the horse approx 6 times, followed by a brief respite, then proceeded to use his whip a further 15 times in the home straight. Mr Allison contended that this was a breach of rule 869 (2) (a).
Mr Thomas agreed with the number of strikes, and also agreed that in hindsight, he should have ‘broken up’ the strikes.
Submissions for Penalty:
Mr Allison submitted, that in his opinion, the offence was at the lower end of the scale. Mr Allison also stated that Mr Thomas had a clear record regarding this rule over the past 12 months.

In determining penalty, the committee had regard to Mr Allison’s comments, Mr Thomas’s driving record, the early admittance of the breach and the penalty guide.
