Decision: Following Race 5 at the Gore Harness Racing Club meeting on 27 December 2008 an information was lodged by Stipendiary Steward Mr P T Knowles, alleging a breach of Rule 869 (3) (a) in that Miss J B Compain, driver of ROGAN, drove incompetently

Following Race 5 at the Gore Harness Racing Club meeting on 27 December 2008 an information was lodged by Stipendiary Steward Mr P T Knowles, alleging a breach of Rule 869 (3) (a) in that Miss J B Compain, driver of ROGAN, drove incompetently by allowing ROGAN to pace (incorrect gait) for the entirety of the race.

Mr Knowles presented a letter from the Acting General Manager of Harness Racing NZ authorising the charge to proceed.

Miss Compain admitted the offence and video evidence confirmed this.

Under Rule 1111 (1) (d) I find the charge proved.

Submissions as to penalty were heard.  Mr Knowles asked for a suspension of 6 weeks, but stated Miss Compain had a clear record for the past 12 months and indeed she had not even been spoken to locally.  He also admitted the stipendiary stewards had missed the offence on the day.

Mr Cox, on behalf of Miss Compain, said she had been in Southland for about 2 years and had driven very few straight out trotters.

--

Miss Compain stated she had not realised her horse was pacing.

PENALTY

--

Taking into account Miss Compain’s clear record, lack of experience and frank admission of the offence, and taking 6 weeks as a starting point, I suspend Miss Compain’s licence for 4 weeks, up to and including Thursday 29 January 2009.
