The Chairman ruled that evidence he heard in the charge of Incompetent Driving by Ms Compain in this race that was given at Central Otago Harness Racing Club meeting at Omakau on 2nd January 2009 be applied to this protest. The Acting Head of Harness Racing has given written consent for this Protest to be heard. This was sighted by the Chairman.
