The Committee used its discretion to disqualify CONTINENTAL BOY as it gained an advantage over all other horses in the race.

Facts:

After the conclusion of race 1 The Sonya McLachlan Equine Density McDougall’s Saddlery Trot. A protest was lodged by Stipendiary Steward Mr S Wallis into the fourth placed horse by the judge CONTINENTAL BOY (2) S Kelly, alleging that he galloped in excess of 50 metres inside the final 200 metres.

The rule reads
870(3) Any horse which breaks from its gait, shall promptly regain its gait.

Breaking Horse Regulations
When a protest has been duly lodged against the placing of an offending horse, The Judicial Committee
II) Disqualify it from the race under rule 1003(2).

Reasons for Decision:

The Committee was satisfied there was a clear breach of the rule 870(3), in that CONTINENTAL BOY failed to regain his gait promptly.
