Facts:

Following the running of Race 10 the Alabar Southern Supremacy Stakes Final Mobile Pace, an information was lodged instigating a protest by Stipendiary Steward Mr C Allison alleging that BETTOR BUY IT (T Williams) who was placed fourth by the judge interfered with the chances of MILLIGAN (Driven by C Ferguson) STARSKYS DREAM (Driven by J Cox) and UNCLE BEN (Driven by N Williamson).

Mr T Williams the driver of BETTOR BUY IT confirmed he was representing the connections of the horse and that they did not wish “to contest the protest”.

The rule reads 869(8)(B):

The Judicial Committee may in addition to any other penalty which may be imposed pursuant to rule 1003 thereof place any horse which,

(B) May have interfered with or whose horseman may have interfered with the progress or chance of any other horse or horses – immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected there by.

Stipendiary Steward Mr Allison showed the committee several video clips of the alleged incident highlighting at the 900 metre mark. Bettor Buy It, Breaking, and Checking Milligan, Stansky’s Dream and Uncle Ben with all these runners losing their chance.

Mr T Williams stated that his horse Bettor Buy It was wearing a shadow roll and had simply “stumbled and over-reacted” causing interference to the horses as stated.

Mr Cox and Mr Ferguson had no submissions.

Reasons for Decision:

Taking into consideration all of the factors the committee was satisfied that BETTOR BUY IT had caused interference to MILLIGAN, STARSKYS DREAM and UNCLE BEN, checking these horses and losing their chance in the race.

The video evidence clearly showed BETTOR BUY IT stumble and brake at the 900 metre mark causing interference to these horses.
