Decision:

At the conclusion of Race One, the Gore Workouts Committee Trot, a protest was lodged by Stipendiary Steward Mr C J Allison, against the third placed horse (ULTER BOY) by the Judge, alleging that ULTER BOY (B G Barclay) started inside the unruly position.  Rule 862 (2), 869 (8) (a). 



At the conclusion of Race One, the Gore Workouts Committee Trot, a protest was lodged by Stipendiary Steward Mr C J Allison, against the third placed horse (ULTER BOY) by the Judge, alleging that ULTER BOY (B G Barclay) started inside the unruly position.  Rule 862 (2), 869 (8) (a).  It was noted that Mr Barclay represented the owners of the horse ULTER BOY at the protest hearing.

Rule 862 (2) reads:
No horseman shall permit a horse to start other than from it’s correct barrier position, unless directed by the starter in accordance with rule 860 (8).

Rule 869 (8) (a) reads:
The Judicial Committee may in addition to any other penalty which may be imposed pursuant to rule 1003 thereof place any horse which (a) may have gained an advantage…immediately after any horse from which it may have gained advantage.

Mr Allison used a video clip to highlight the alleged incident, stating that ULTER BOY was one of three horses to start on the unruly position, and that his position was number one.  Mr Allison stated that ULTER BOY started three or four places inside the correct starting point.

Mr Allison questioned the Official Starter, Mr B Ward, whether he gave Mr Barclay any specific instructions.   Mr Ward stated that he was generally happy with the starting configuration.

Mr Barclay said he had asked the starter whether position five or six was about the centre of the track, which Mr Ward did not respond to.  The Committee asked Mr Allison if he considered ULTER BOY had gained an advantage from the incident; Mr Allison stated that ULTER BOY raced three deep on the marker line and, in his opinion, was not seen as an advantage.

Mr Barclay stated his horse was head-strong and that he would have preferred a racing position wider on the track.

Decision:
The protest was dismissed.  The Committee was satisfied that ULTER BOY had gained no clear identifiable advantage from its actual starting position.
