The charged was found proved.

Penalty:

Mr Williamson was fined the sum of $350.00 and suspended up to the completion of racing on Saturday March 19th 2011.

Charge:

An information (68863) was lodged by Stipendiary Steward Mr C J Allison under rule 869(3)(b) in that shortly after the start M J Williamson (Jaccka Twain) shifted ground inwards when insufficiently clear of Shinko (B R Shirley) with a resulting check to Ya Dreamin (A Sanderson) which fell.

The rule reads:
No horseman shall drive carelessly.

Mr Williamson did not admit the breach.

Facts:

At the outset of the hearing the Chairman asked all parties if they agreed to their statements that were made in the protest hearing 13735 and if they could be taken as an accurate record.
All parties agreed.

The committee viewed the video clips again of the alleged incident and gave all parties the opportunity to introduce any new information or evidence they thought would be appropriate to bring to the hearing.

Submissions for Decision:

Mr Knight the trainer of Jaccka Twain and representing Mr Williamson wanted to clarify the distance between Mr Barclays horse (Donthavetime),Mr Williamsons horse (Jaccka Twain) and Mr Shirley’s horse (Shinko).

Mr Knight continued to say that just after the release of the mobile Mr Shirley’s horse had it’s head on its side and looked like it was running in. He also believed his horse was clearly in front of Mr Shirley’s horse and that Mr Barclay is looking out for his wheel.

In Mr Knight’s opinion he suggested that Mr Barclay had contributed to the incident. He also said that we must rely on the Drivers opinion and he questioned Mr Shirley if he had touched wheels and it was very hard to tell from the film.

Mr Knight continued stating that Mr Shirley should have taken hold of his horse and that the general tightening had caused the incident.

Mr Barclay responded to Mr Knight’s question stating that he had looked down at the wheel to ensure he was clear and that he believed there was room for Mr Williamson to come out if he needed it.

Mr Shirley stated that just because Jaccka Twain was slightly ahead he had no right to his space and that he denied racing room for both himself and Mr Sanderson.

Mr Shirley emphasized the whip action of Mr Williamson on the video clip stating that he never stopped driving his horse into the gap that was not there.

Reasons for Decision:

The committee after viewing the video clips was satisfied that a breach of the rule had occurred.
In our opinion Mr Williamson has made a simple error of judgement of moving inwards when he was not clear of the two inside horses Shinko and Ya Dreamin eventually causing Shinko to move inwards onto Ya Dreamin causing this horse to fall and disrupt many other horses racing chances.

The committee does not believe that any other horse or horseman has contributed to the incident.

Submissions for Penalty:

Mr Allison stated that Mr M Williamson had one breach under this rule in the past twelve months at the Wairio Meeting on the 17.10.2010 where he was fined the sum of $250.00.

Mr Williamson is a very successful junior horseman who is normally having up to eight trace day drives.

Mr Allison said he believed that the range of carelessness on this occasion was mid range.

Mr Williamson said he had in the next few weeks some important up and coming drives and that personally a fine would be a better result so that he could honour his driving engagements.

Reasons for Penalty:

Mr Williamson was given some credit for his driving record however he was reminded of his professional obligations.
In this instance his error of judgment has caused a horse to fall and many other horses chances affected.
