The protest was upheld and the second placed horse by the judge Jaccka Twain was disqualified.

Facts:
At the conclusion of race 5 the Pioneer Supporters Club Mobile Pace a protest was lodged by Stipendiary Steward Mr C J Allison alleging that Racing into the first bend Jaccka Twain(M J Williamson) shifted ground inwards when insufficiently clear of Shinko(B R Shirley) and Ya Dreamin(A Sanderson) causing Ya Dreamin to fall.
Jaccka Twain was placed second by the judge.

Submissions for Decision:
Stipendiary Steward Mr Allison showed the committee several video clips of the alleged incident(Head on, Side on) highlighting in his opinion the inward movement of Jaccka Twain onto Shinko and in turn onto Ya Dreamin.
Mr Allison stated that he did not believe Mr Williamson was sufficiently clear of the inside horses ,Shinko and Ya Dreamin causing these horses to be tightened with eventually Ya Dreamin falling and many other horses having their chances extinguished.
Mr Barclay (Donthavetime) state that he was clear moving forward into the first bend and that he could hear Mr Shirley calling out on the inside to give him room.
Mr Barclay was of the opinion that all horses had held their line and that he looked down to ensure that he was clear before crossing to the lead just prior to the first bend.
Mr Adams the trainer of Donthavetime stated that his horse was entitled to cross over to the lead and that his horse was clear and did not contribute to the incident.
Mr Shirley (Shinko) stated that he yelled out to Mr Williamson to give him room he also said that he was entitled to maintain his line and simply ran out of room by the that inward movement of Jaccka Twain.
When questioned Mr Shirley stated that his horse did not contribute to the incident in any form.
Mr Sanderson (Ya Dreamin) stated that he had held his line on the fence and that he heard Mr Shirley yelling out that he needed room. Mr Sanderson stated that Mr Shirley was forced onto him by the inward movement of the horse racing outside Mr Shirley (Jaccka Twain)
When questioned Mr Sanderson stated that his horse did not contribute to the incident in any form.
Mr Williamson stated that Mr Shirley’s horse was hanging in from after the mobile had been dispatched and he believed that there had been some general tightening that several horses had contributed to.
Mr Williamson was also of the opinion that there had been some inward movement from Mr Barclays horse Donthavetime.
Mr Knight trainer of Jaccka Twain agreed that the racing had got tight but he could not see Mr Shirley’s horse make contact with his horse and he asked where or if contact had been made.
Mr Shirley responded simply saying he had nowhere to go and as a result he made contact with Mr Sanderson’s horse Ya Dreamin.
Mr Armour in supporting Mr Williamson stated that he believed the point of discussion should have been 50metres prior to the incident where he believed that several horses had contributed to the inward movement.
Mr Smaill (Owner Jaccka Twain) stated that he believed all the horses affected had kept their line racing into the bend and that there had been some general tightening.
Reasons for Decision:
The committee was clearly satisfied that Jaccka Twain (M Williamson) had moved inwards when he was not sufficiently clear of the inside horses Shinko and Ya Dreamin forcing these horses to come in contact when there was insufficient room for them to get around the first bend.
Mr Williamson has driven his horse up into a position that clearly there was not sufficient room to do so
The video evidence also clearly supports the findings along with the compelling evidence of Mr Shirley, Mr Sanderson and Mr Barclay all of whom were in no doubt that Jaccka Twain had caused the incident.
