The Committee was satisfied a clear breach of the rule had occurred, Mr Bond clearly moved out onto EXOTIC GIRL and LITE BOURBON.

Mr Bond had taken no remedial action, and has in fact used his whip on WIND RUNNER, rather than taking any corrective action to ensure WIND RUNNER ran in a straight line.

Penalty:

Mr Bond was suspended from the conclusion of racing on Sunday 11th March 2012 up to the conclusion of racing on 1st April 2012. Effectively three lower South Island racing days.

Mr Bond admitted the breach and did not wish to be present at the hearing.

It was agreed that the evidence given at the protest hearing A5988 was an accurate account of the proceedings.

Stipendiary Steward Mr Allison stated that the major concern the Stipendiary Steward had with the incident was that Mr Bond had used his whip several times, after WIND RUNNER had moved out, and did not take any evasive or corrective action.

Mr Allison also stated that two horses had their chances extinguished as a result of the incident.

Mr Allison stated that Mr Bond had a good record. He had thirty eight race day drives this season , and sixty seven in total for last season.

Mr Allison believed the degree of carelessness in this instance was mid range.

Mr Bond was not present and as a result there were no submissions on penalty.

Reasons for Penalty:

The committee after viewing the video evidence was satisfied that “WIND RUNNER” has moved out when not sufficiently clear causing interference to both EXOTIC GIRL & LITE BOURBON. Both of these horses' chances where affected as a result of the incident. Mr Bond was also clear in his evidence that interference had occurred and he did not contest the protest.
