As Mr Purdon had admitted the breach of the rule it was found to be proved.

Accordingly, Mr Purdon was fined the sum of $200.

Facts:

Following the running of Race 2 an Information was filed by Stipendiary Steward Mr P Williams alleging a breach of Rule 864(2)(d) by Trainer Mr M Purdon. The Information stated that “Trainer M Purdon (DIXIE FLYER) failed to secure the girth safety strap so as not to come adrift resulting in a false start being declared to rectify the issue.”

Mr Purdon had signed the Information stating he admitted the breach and that he was conversant with the rule.

Rule 864(2)(d) states: “Every horseman, owner, trainer, and assistant thereof of a horse shall with regard to that horse ensure that…all gear is correctly applied and/or affixed so as not to malfunction or come adrift”.

Mr Williams explained to the Committee this breach is one usually dealt with under the minimum fine regime but as it has caused a false start a charge had been lodged.

Submissions for Penalty:

Mr Williams said Mr Purdon has a clear record under this rule. He said the consequences of this breach was it caused a false start and that he would leave it to the Committee to determine any uplift in Penalty from the normal fine of $100.

Mr Purdon made no submissions on Penalty but informed the Committee it was his first breach of any rule.

Reasons for Penalty:

The Committee has considered the evidence and agree that failure to affix the gear properly on DIXIE FLYER has caused a false start. It considers this factor plus one of safety, warrants an uplift of the penalty and therefore considers a fine of $200 an appropriate penalty in this case.
