Decision:
The Committee ruled that horse QUICK AS A TRICK had been denied a fair start. It was ordered that it be scratched from the race.
It was further ordered that dividends for the race be amended accordingly.
Facts:
Following the running of Race 9, the Fresh Choice Geraldine Cup C4+Handicap Pace, an information requesting a ruling under Rule 213 (1) (j) was filed by Stipendiary Steward, Mr S Renault to determine whether QUICK AS A TRICK, driven by Mr J Cox, was denied a fair start.
Rule 213 provides as follows:
(1) A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:-
(j) if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.
Submissions for Decision:
The Committee was satisfied that QUICK AS A TRICK was denied a fair start in the race. It had drawn unruly on the 10m line for the standing start event. Prior to the start, the horse was misbehaving although had settled to some degree prior to the start being declared. We were satisfied that QUICK AS A TRICK was side on or a 45 degree angle to the start line when the start was made and therefore its chances were materially prejudiced as a result.
Reasons for Decision:
Mr Renault showed video replays of the start of Race 9, a standing start 2850 metres event for pacers. He pointed out QUICK AS A TRICK, driven by Mr Cox, having drawn the unruly position on the 10m line. He pointed out QUICK AS A TRICK rearing up and misbehaving at the start. He stated that as the starter released the field QUICK AS A TRICK was standing side on or at a 45 degree angle to the start and therefore denied a fair start.
Mr Cox said the horse was fractious around at the start and was facing sideways when the start was made. He said that QUICK AS A TRICK was definitely denied a fair start
Starter Mr J Hooper stated that he was aware of QUICK AS A TRICK misbehaving on the 10m line. He said that QUICK AS A TRICK was more side on to the start than he realised after viewing the videos and probably would not have declared a start had he realised how side on the horse was positioned.
