Facts:
Following the running of Race 10, the Geraldine ITM/Goldenedge Handicap Trot, an information instigating a protest was filed by Stipendiary Steward Mr N G McIntyre alleging “Larix” (8), which finished 5th, was in a break for a distance in excess of 150 metres during the race, which was in breach of Rule 870 (3) and the Breaking Horses Regulations.
The Judges official placings in this race were as follows:

The Information reads as follows.
“in the early stages Larix galloped in excess of 150 metres”
Rule 870 (3) provides as follows,
“Any breaking horse which breaks from its gait shall promptly regain its proper gait”
Clause (a) of the “Breaking Horses” Regulations provides as follows,
“Any horse which breaks from its gait either at the start or during the running of any race and continues on in a break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.
Mr McClymont, trainer of Larix, had endorsed the information “I do not contest the protest” Mr McIntyre advised the Committee that the affected parties did not wish to attend the hearing.

Mr McIntyre illustrated by use of race video that “Larix” had broken its gait prior to the 1000 metre mark and had galloped until after the 800 metre mark. His estimate was that the horse had continued to gallop for a distance in excess of 260 metres, well in excess of the allowable 150 metres under the Breaking Horses Regulations.
Mr McIntyre submitted that “Larix” should be disqualified.
Reasons for Decision:
We were satisfied that “Larix” galloped for well in excess of 150 metres during the race and should be disqualified from its 5th placing under the provisions of Rule 1003 (2).
