Following the running of Race 8 the Stipendiary Stewards filed and information instituting a charge against JM Gray the driver of Song for Ireland alleging that he used the whip excessively from the 500 metre mark to approximately the 150 metre mark from the finish of the Race.

Following the running of Race 8 the Stipendiary Stewards filed and information instituting a charge against JM Gray the driver of Song for Ireland alleging that he used the whip excessively from the 500 metre mark to approximately the 150 metre mark from the finish of the Race.

At the outset of the hearing the Committee noted that the Defendant had admitted the breach in writing and had chosen not to be present at the hearing.

The Stipendiary Stewards said that they noted Mr Gray commencing hitting his horse and/or sulky with approximately 500 meters to run and that this action continued until approximately 150 meters from the finish. The video evidence confirmed the statement made by the Stipendiary Stewards. The charge is accordingly found proven.

In respect of penalty, Mr Escott advised the Committee the Mr Gray had a previous proven charge under this Rule on the 21st April 2005 at which time he was fined $200.00. Mr Escott submitted that on this occasion a period of suspension was appropriate and he advised the Committee that Mr Gray had been told that the Stipendiary Stewards would be seeking a suspension.

The Stipendiary Stewards also advised that Mr Gray did not drive at every meeting in the area and when he did he had one or two drives only. The Committee after giving consideration to the Stipendiary Stewards submissions, noting that Mr Gray had decided not to appear at the hearing and giving Mr Gray credit for his guilty plea imposes a period of suspension from the completion of racing today until the completion of racing on 4th day of December 2005. [an effective 3 day penalty.)
