The protest was upheld and AORANGI was disqualified from the race.

Consequent upon the disqualification, the amended result for the race is as follows:

1st – 8 BAXTER
2nd -6 KASH VALLEY
3rd – 7 RUBY SEDDON
4th – 1 ABOUT LAST NIGHT
5th – 11 RITES OF ZHOU
6rd - 9 JIMMY CARTER

It was ordered that the dividends and stakes be paid in accordance with the amended result.

Facts:

Following the running of race 2, the PGG Wrightson Standardbred / Team Teal Trot, an information instigating a protest was filed by Stipendiary Steward Mr S Renault, against AORANGI (S Ottley), placed 3rd by the judge, on the grounds that it “galloped in excess of 50 metres in the final 200 metres”.

Mr K Townley and Ms S Ottley, the connections of AORANGI had endorsed on the information form and signed “I do not contest the protest”.

Mr Renault confirmed that Mr Townley and Ms Ottley did not wish to be present at the protest hearing.

The official placings for the race were:

1st – 8 BAXTER
2nd – 6 CASH VALLEY
3rd – 10 AORANGI
4th – 7 RUBY SEDDON
5th – 1 ABOUT LAST NIGHT
6th – 11 RITES OF ZHOU

Rule 870(3) provides: that any horse which breaks from its gait during a race must promptly return to its correct gait.

Section B of the Breaking Horses Regulations provides: that any horse which breaks in the last 200 metres of a race and continues in a break for a distance of 50 metres or greater shall be in breach of Rule 870(3).

Submissions for Decision:

Mr Renault with the assistance of Mr Ydgren showed the race video replay of the final 200 metres of the race.

He identified AORANGI, driven by Ms Ottley, leading the field in the middle of the track passing the 150 metre mark. At approximately the 70 metres he pointed to AORANGI rolling into a gallop, free of interference, and continue on in a gallop past the finishing line in third place.

Mr Renualt submitted that the horse had galloped for a distance of approximately 60 metres. He sought disqualification of AORANGI.

Reasons for Decision:

The Committee was satisfied that AORANGI had broken from its gait, free of interference, approximately 60 metres from the finishing line and had continued in a gallop past the finishing line, being placed 3RD across the line and, therefore, failed to promptly regain its proper gait in breach of Rule 870 (3) and the Breaking Horse Regulations.

The Committee noted that Mr Townley and Ms Ottley did not contest the disqualification of AORANGI.
