As Mr Ford has admitted the breach the charge was found proved.

Accordingly, Mr Ford is suspended for 4 days on the following dates:
23 February 2017 (New Zealand Metropolitan Trotting Club), 26 February 2017 (Methven Trotting Club), 3rd March 2017 (New Zealand Metropolitan Trotting Club), 5th March 2017 (New Zealand Metropolitan Trotting Club).
Facts:
Following the running of Race 4, the Michael Jones Geraldine Butchery Trot 2500m, an information was filed by Chief Stipendiary Steward, Mr N Ydgren against Licensed Horseman, Mr C Ford, alleging a breach of Rule 869(4)(6)(b)(c), in that when driving ROCKNPOP Mr Ford shifted outwards near the 1850m forcing ANNE KATE (N Edmonds) to race wider.
Rule 869(4)(6)(b)(c) reads as follows:
“(4). No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.”
(6). Subject to sub-rule 4 hereof:
(b) the horse making a forward movement during any race shall not be forced to race wider on the track;
(c) the horse during a race shall not move ground outwards once the nose of the wider running coming forward is in line with or past its sulky wheel and until the wider running going forward it fully past.”
Mr Ford indicated that this breach of the rules was admitted and notified the committee via Stipendiary Steward Mr McIntyre that he did not wish to attend the hearing.
Mr Ydgren gave evidence and used video coverage to show that near the 1950m, Mr Ford driving ROCKNPOP, was racing three back on the running line. Mr Edmonds was approximately three lengths behind him but improving quickly. Mr Ford then shifts outwards to the two wide line. However, by that time Mr Edmonds had become established to Mr Ford’s outside wheel. As a consequence Mr Edmonds was taken to a three wide position for some distance before having to restrain his drive and lose that position.
The two horses ran first and second. There is no suggestion – and Mr Edmonds concedes – that his horse’s winning chances were not affected as a result of this incident.
Submissions for Penalty:
Mr Ydgren submitted that Mr Ford has a clear record and that for a breach of this rule, in circumstances as clear cut as this, the starting point is a fine of $250 having regard to the guidelines, or alternatively a 5 drive suspension. Having regard however to Mr Ford’s admission and to his good record, Mr Ydgren submitted that he be fined $200. At that point Mr Ydgren informed the committee that Mr Ford preferred to be suspended and that an appropriate calculation for suspension may be a 4 day suspension at a number of upcoming Canterbury meetings.
Reasons for Penalty:
In taking the JCA penalty guide starting point of a $250 fine, the committee were able to give Mr Ford a discount of $50 for his admission of the breach and his clear record. Accordingly, in the event that he were to be fined he would be fined $200. However, having regard to Mr Ford’s submission that he would prefer to be suspended, the committee has determined to adopt a 5 day suspension as the appropriate starting point which will be discounted to a 4 day suspension.
The committee has determined to suspend Mr Ford for what is in effect a 4 drive suspension. The committee has reached this decision on the basis that Mr Ford is a consistent but low volume driver. He has had 18 drives this season and only 35 drives last season. He consistently drives one horse per meeting and according a fair punishment in all circumstances is a 4 day suspension as proposed.
