Facts:

Following the running of Race 8, the “Mainfreight Geraldine Cup” an Information Instigating a Protest was filed by Stipendiary Steward Mr Wallis alleging interference by “Live Lea” (3), driven by Mr Williamson, to “Glencoe VC” (13), driven by Mr O'Reilly.

The Judge’s placings in this race were as follows:

The Information reads as follows:

“....Alleged interference when LIVE LEA (M.Williamson) shifted out checking GLENCOE VC (G O”Reilly) which broke”

Rule 869 (8) provides as follows:

“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which,

(a) may have gained an advantage by any contact or interference prohibited by any preceding provision of this Rule and/or

may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby."

Submissions for Decision:

Stipendiary Steward Mr Wallis using the race video illustrated how shortly after entering the home straight “Live Lea” had been racing in the one one position with “Glencoe VC” on its outer. Mr Wallis's evidence was, “Live Lea” on leaving the one one position to make a run, struck “Glencoe VC” causing that horse to go into a break and lose ground.

Mr O'Reilly gave evidence of racing on the outside of “Live Lea” when the latter made contact with his horse. As a consequence “Glencoe VC” went into a break and lost ground.

Mr Williamson gave evidence stating any contact with Mr O'Reilly's horse was minor. He drew the Committee's attention to the appearance that “Glencoe VC” was lugging in onto his horse immediately before going into a break. He contended that this had contributed to the incident.

In answer to a question from Mr Wallis, Mr O'Reilly confirmed his horse was lugging in immediately prior to going into a break. He also confirmed the horse was prone to making mistakes.

Mr McStay, the trainer of “Live Lea”, joined the hearing when it was partly heard. He viewed the race video but had nothing to add.

Reasons for Decision:

The Committee was satisfied that “Glencoe VC” was lugging in immediately prior going into a break. We were also satisfied that “Live Lea” made little if any movement away from the running line prior to “Glencoe VC” going into a break.

When “Glencoe VC” went into a break he moved up the track leaving room for “Live Lea” to leave the running rail and take up open racing room. The horses were racing in comparatively tight quarters and we concluded the contact between the horses and the reason for Glencoe VC” going into a break may have been contributed to by “Glencoe VC” lugging in.

We were satisfied there was insufficient evidence to uphold the protest. Accordingly the protest was dismissed and placings remained unchanged.
