Facts:
Following the running of Race 7, the “The North End Ford Pace”, an Information Instigating a Protest was filed by Stipendiary Steward S Wallis alleging Flyalong Falcon broke inside 50m and was lapped on by Gliding Charm.
The Judge's placings in this race were as follows:
1st - The Friendly Assassin (14)
2nd- Fiery Lustre (3)

The Information reads as follows:
“…..that Flyalong Falcon (5th) broke inside the final 50m being lapped onto Gliding Charm”
Rule 870 (5) provides as follows:
“Not withstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided where such first mentioned horse is not in its correct gait as a result of interference to such or its horseman, then (subject to rule 869 (8) such relegation of the horse shall be at the discretion of the Judicial Committee.”
Submissions for Decision:
Mr Dunn had endorsed the information “I do not contest the protest”. Stipendiary Steward S Wallis advised the Committee that Mr Dunn did not wish to attend the hearing.
Mr Wallis, with the assistance of the Race Video, illustrated that free of any interference “Flyalong Falcon” had broken from its gait inside the 50m and at the finish while still in a break had been lapped on by “Gliding Charm”. He confirmed “Gliding Charm” was in its correct gait. He gave the margin at the finish between the two horses as 0.9. Mr Wallis produced the photo finish of the race which clearly showed “Flyalong Falcon” being lapped on by “Gliding Charm”.
Mr Wallis submitted “Flyalong Falcon” should be relegated to 6th place behind “Gliding Charm”.
Reasons for Decision:
The protest was not contested by the driver of “Flyalong Falcon” (Mr Dunn). Evidence presented by Stipendiary Steward S Wallis clearly established that “Flying Falcon” broke from its proper gait clear of any interference inside the 50m, continuing in a break being lapped on by “Gliding Charm”. At the finish of the race “Gliding Charm” was in its correct gait.
