Following the running of race 8 the Stipendiary Stewards lodged an information instigating a protest in respect of Cronadun, horse no. 15, placed 3rd by the Judge. The information alleged that Cronadun interfered with Ed’s Dream horse no. 5 approximately 100 metres from the finishing line. The protest was lodged pursuant to rule 869 (8). The rule reads:

"(8) The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place ay horse which:

    1. may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or --

      --

      --
    2. may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses- --

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby."

The protest was contested. Mr N. Jones advised that he was representing the connections of Cronadun.

Mr McIntyre in opening of the protest hearing for the Informant said that with approximately 100 meters to run Cronadun (A Vent) interfered with the Ed’s Dream (D Pascoe) causing that horse to break and lose all chance.

Ms D Pascoe said that with approximately 100 metres to run she was racing five of six wide on the track with horses inside her and horses improving on the outside. She said that there was pressure from the inside and she allowed Mr Vent as much room as she could but eventually his horse moved out onto her horse causing it to break and lose all chance. She further said that she had attempted to give Mr Vent as much room as she could but her position was dominated by the horse immediately on her outside.

Mr L McCormack (Stray Shot Shamrock) said that he was on the inside of Mr Vent’s horse battling but holding its own when Mr N Williamson (Entrapment) moved out causing him over extra ground and he then straightened. He said at the time of the second incident his horse was going straight and the pressure from the inside had ceased.

Mrs D Williams presented the video evidence and asked the Committee to note that it was the Stipendiary Stewards view that there were two incidents, the first when Mr Williamson’s horse moved out and the second when Mr Vent’s horse moved out and came into contact with Ms Pascoe’s horse. She asked the Committee to note the sequence of the two incidence and in her view the sole reason for Ed’s Dream breaking was the latter movement out by Cronadun. Mrs Williams also said that Stray Shot Shamrock was racing straight at the time of the second of the two incidences and there was sufficient room between Stray Shot Shamrock and Ed’s Dream to allow Mr Vent to move out and forward in safety, however, he moved out much further than was necessary and as a result came into contact with Ms Pascoe’s horse. She pointed out to the Committee the distance between Stray Shot Shamrock and Ed’s Dream just prior to the interference to Ed’s Dream and said that there appeared to be one and a horse widths between the horses at that time.

Mr M Jones, who was representing the connections of Cronadun and assisting Mr Vent, said that in his view there was only one incident and it was all caused by the horse on the inside and that as a result Mr Vent’s line was dictated. He contended that Mr Vent could not pull back due to the positions of the horse but could not demonstrate this with the assistance of the video evidence.

The Committee, after giving consideration to the evidence of all persons present, finds as follows:

  • There were two incidence, the first the movement out of Mr Williamson’s horse which did force Stray Shot Shamrock and Cronadun out further, however, that movement had ceased when Mr Vent endeavoured to move through a gap between Stray Shot Shamrock and Ed’s Dream and in doing so took his horse wider than was necessary, the gap was at least one and a half widths, and came in contact with Ed’s Dream. --

  • As a result of that contact Ed’s Dream lost all chance and Cronadun ran on strongly finishing third. --

  • There is no reason for the Committee to exercise its discretion. --

Accordingly, Cronadun is relegated from 3rd place to 12th place immediately behind Ed’s Dream.
