Following the running of race 1 an information was lodged by the Stipendiary Stewards under rule 870 (3) and the Breaking Horse Regulations alleging that at the start of the race My Three Lads was in a gallop and was still out of its gait

DECISION & REASON
--Following the running of race 1 an information was lodged by the Stipendiary Stewards under rule 870 (3) and the Breaking Horse Regulations alleging that at the start of the race My Three Lads was in a gallop and was still out of its gait after approximately 170 metres from the start. The relevant rule reads:
------"870 (3) Any horse which breaks from its gait shall promptly regain
--its proper gait."
--Breaking Horse Regulations (b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait."
----At the outset of the hearing Mr Scott accepted that My Three Lads had breached the rule and the Breaking Horse Regulations.

Mr McIntyre demonstrated the incident with the assistance of the video camera which showed My Three Lads out of its correct gait at the start of the race and not regaining its correct gait until some 170 metres or more after the start. He sought the disqualification of My Three Lads.
The evidence presented is not contested and, accordingly, My Three Lads (8) is disqualified from the race. The placings now read:
