Horseman Mr B Edwards was charged with driving Dauntless carelessly causing interference to Burt Munro racing around the first bend.
Facts:
Stipendiary Steward Mr J Muirhead referred the committee to video footage of the early stages of race 1 and indentified the relevant runners.
He indicated where Mr Edwards driving Dauntless moved down onto the running line when not sufficiently clear of Burt Munro. In doing so his sulky came into contact with the front legs of Burt Munro causing that horse to break and lose about 5 lengths.

Mr Muirhead submitted the starting point was suspension for 8 drives or a $400 fine. He said that Mr Edwards had recently returned to race driving and had 11 drives this season. He had no previous breaches and this breach was at the lower end of the scale. He ought to be given credit for his admission and submitted a fine of $250 as penalty.
Mr Edwards believed the driver of Burt Munro should have eased back a foot or so and allowed him to take up the position on the rail.
He made no submissions on penalty.

In arriving at a suitable penalty the committee took into account Mr Edwards' limited experience as a driver. He had a clear record and had admitted the breach which was assessed as being at the lower end of the scale of seriousness. The committee also took note of penalties for similar breaches.
