Following the running of race No 4, an information was filed alleging a breach of the rules.     Mr. Muirhead alleged that Mr. H Cullen was in breach of rule 869 (3) (b), "Careless Driving?,

Following the running of race No 4, an information was filed alleging a breach of the rules.

Mr. Muirhead alleged that Mr. H Cullen was in breach of rule 869 (3) (b), "Careless Driving?, and the information stated that Junior horseman Mr. H Cullen drove "Whodatdare", carelessly tightening Double Dream (Mr. J Rattery) causing it to break with approximately 1000m to run.

Mr. Cullen admitted the breach of this rule and was present at the hearing of this information.

Mr. Cullen was asked by the chairman if he had a senior horseman to assist him and Mr. Cullen advised he did not wish to have one present.

Mr. Muirhead showed the video of this incident at the 1000 meter mark and made submissions on penalty as did Mr. Cullen.

Mr. Muirhead in his submissions stated that this offence was at the lower end of the scale and recommended a 2 day suspension of Mr. Cullen's horseman's licence.

Mr. Cullen stated in his submissions on penalty he preferred a suspension as against a fine.

This Judicial Committee having taken into consideration the submissions on penalty from both Mr. Muirhead and Mr. Cullen also Mr. Cullen's very good driving record and his admission of the breach of this rule imposed a 2 day suspension of Mr. Cullen's horseman's licence to and including the 21st July 2006.
