The Rogerson/Blanchard Partnership is fined the sum of $200.00.

Facts:

Following the running of the PEGASUS SPUR HANDICAP TROT an Information was lodged by Stipendiary Steward Mr BJ van Kan against the licensed training partnership of G Rogerson and P Blanchard alleging that they presented THE SCRUFF to race without the notified Pacifier.

Rule 865 provides: that Trainers must give notice of notifiable gear to be used by a horse in a race and a horse is not to be presented in the assembly area without the notified gear.

Mr Blanchard endorsed the Information with an admission of the breach and also that he did not want to be present at the Hearing.

Submissions for Penalty:

Mr van Kan said that this charge was normally dealt with under the Minor Infringement provisions in the Rules but because this was the 3rd breach by the Rogerson/Blanchard Partnership within 3 months it was being dealt with by way of Information and Hearing.

He did not make any further submissions as to penalty.

Reasons for Penalty:

In setting penalty I note that the Rogerson/Blanchard Partnership has admitted the charge.

I am concerned however that this is the Partnership's 3rd breach of this Rule since the 16th of December 2014. That is just over two and a half months. That is an aggravating factor and this impacts on the penalty for this breach and any penalty must be significantly higher than that for a Minor Infringement breach.

I believe that a fine of $200.00 is appropriate.
