| ---- DECISION AND REASONS: ----This information alleged a breach of Rule 869 (3) (b) by Junior Horseman Mr. Noakes, which he admitted. It alleged that he drove TOHEROA carelessly striking the wheel of the sulky of MY POCKET OF HOPE (Jordan Compain) with 1600 metres to run causing his own horse to break losing its chance. Mr. Noakes was represented by Horseman Mike Nicholas. ----Mr. Muirhead demonstrated the incident on video pointing out the breaking of TOHEROA as it attempted to ease off MY POCKET OF HOPE and as a result lost all chance and finished at the rear of the field. Mr. Noakes, he said, had no previous breaches in the last two years and was driving about once a week having had 41 drives last year and 13 so far this season. He was entitled to credit for that and for admitting the breach. A penalty of $200.00 or two days suspension was suggested. Mr. Noakes confirmed he had been driving for three years and expected more driving opportunities in future. He asked that a suspension be ordered rather than a fine. ----The Committee, after taking these matters into consideration, accepted the submission by Mr. Noakes and accordingly ordered suspension of his Junior Horseman's License to take effect up to and including the conclusion of racing on 3 December 2004 a period involving two days. ------ -- -- --
