The charge has been admitted and is therefore proved.

Penalty:

The Committee fines Mr Alexander the sum of $200.00.

Facts:

Following the running of the FRUCOR CLASSIC MOBILE PACE an Information was lodged by Stipendiary Steward Mr JM Muirhead against Open Horseman Mr DM Alexander alleging that Mr Alexander failed to maintain barrier position 3 at the start when driving IDEALISTIC.

Mr Alexander admitted the breach and advised the Committee that he did not wish to be present at the Hearing.

Mr Muirhead demonstrated the incident by use of the race films and showed that as the barrier was about to be released IDEALISTIC was not up in position and prior to release Mr Alexander crossed over to the running line. He was clearly not in the correct position when the barrier was released.

Submissions for Penalty:

Mr Muirhead referred to the JCA Penalty Guidelines which provide for a starting point penalty of suspension of Licence for 5 drives or a $250.00 fine. He said that Mr Alexander had a good record but that this was a blatant breach of this rule. He also said that it was important to maintain the integrity of the start. He submitted that a fine of $200.00 was appropriate.

Reasons for Penalty:

The Committee agrees with Mr Muirhead that this was a blatant breach of the rule. Mr Alexander has admitted the breach but clearly he had to but we do give him credit for his good record.

Mr Alexander has had 5 drives this season and therefore suspension of his Licence is not appropriate.

The Committee therefore will deal with this by way of fine and we believe that the level of fine submitted by Mr Muirhead is appropriate.
