DECISION & REASON
--An information lodged by Stipendiary Steward Mr J Muirhead against Mr P Miller, driver of SHAKIRA LASS, alleging a breach of Rule 869(3)(b) ? careless driving ? in that he carelessly moved his horse inward where there was insufficient room forcing Mr P Ferguson, driver of BARN DANCE BETTY, to take severe evasive action shortly after the start. Mr Miller admitted the breach and was present at the hearing.
--Mr Muirhead demonstrated the incident by use of the video film. Shortly after the start Mr Miller moved his horse inwards when insufficiently clear of BARN DANCE BETTY causing driver Mr P Ferguson to strongly restrain that horse. It was fortunate that BARN DANCE BETTY did not break at that stage.
--Penalty:
--Mr Muirhead said Mr Miller had no relevant breaches of the rules recorded against him. He said Mr Miller had only had three drives this season, 23 drives last season, and one drive the season before that. He suggested a suspension in the range 2-4 weeks. Mr Miller said his driving was not as bad as it had been made out to be. He said Mr Ferguson did not call out. He said he had two horses in work and they were the only horses he drove. He said he thought 2 weeks suspension was appropriate.
--In fixing penalty the committee took into account the following matters:

- Mr Miller's clear driving record --
- The offending was mid range on the scale of seriousness.
Balancing those matters, the committee suspended Mr Miller's horseman's licence for 2 weeks that is until the end of racing on The 3rd of November 2006.
