Information 66177 alleged a breach of Rule 869(3)(b) by Miss N. Thorn (SKY TREK) for driving carelessly when she moved her horse inwards with approximately 350m left to run forcing REUNION (B. Lee) down on to VAN ANTONI (J. Abernethy) causing it to be pushed down on to the pylons and breaking as a result. Also checked was ROYAL DIRECT at this point.

Mr Taumanu demonstrated the incident on video pointing out the runners and showing the tightening to Mr Lee and REUNION which broke and lost all chance at this point.

Mr Lee confirmed he was travelling round the bend and Miss Thorn was outside him three wide. She had come across to get a better run and her horse was hanging in causing the tightening which occurred. She had yelled but he was unable to do anything as he was having difficulty with his horse. His legs were up inside SKY TREK and he was unable to grab his horse to give the horse inside room.

Miss Thorn explained that she did not move inwards and it was SKY TREK which ran in of his own accord. As he began to drift she had yelled and taken corrective action but the tightening continued despite this. She did not believe she had driven carelessly and was taking all appropriate action but the horse continued to drift and it was the cause of the tightening.

The Committee has considered the evidence and the videos and has found that for a driver of Miss Thorn's experience she was capable of keeping SKY TREK out and should have been able to prevent it hanging in. It was not as if she had any pressure on her from outside. Therefore, she was found to be in breach of the rule for failing to discharge her obligations in this situation.

After hearing submissions on penalty and having regard to Miss Thorn's very good record, the Committee was satisfied that a fine would be appropriate and she was ordered to pay the sum of $250.00.
