Decision: An information was lodged by Stipendiary Steward Mr TW Taumanu against Mr T Grayling, the driver of Zutano, alleging that Mr Grayling drove carelessly

An information was lodged by Stipendiary Steward Mr TW Taumanu against Mr T Grayling, the driver of Zutano, alleging that Mr Grayling drove carelessly when he moved his horse outwards with approximately 250 metres left to run and, in doing so, he checked Frankie Maguire (driver M White), causing that horse to lose its chance.

Mr Grayling admitted the breach but did wish to be present at the hearing.

Mr Taumanu, in giving evidence, demonstrated the incident by use of the video films and showed the outward movement by Mr Grayling.  Mr Taumanu said that this was not a serious incident of its type and that Mr White's horse's legs only brushed the wheel of Mr Grayling's sulky but that it was sufficient to cause his horse to break and lose its chance.

Mr Grayling said that he did not realise Mr White was near him and he did not realise that he did come into any contact with Mr White's horse.  He did, however, after hearing Mr Taumanu and also viewing the films, again acknowledge that he had caused the interference.

Mr Taumanu submitted that this incident was at the medium to lower end of the scale and he submitted that a fine of $250.00 was appropriate.  Mr Grayling accepted this.

Taking all matters into account, including the evidence, the result of Mr Grayling's actions, the submissions made and the frank and open manner in which Mr Grayling accepted liability, I am prepared to deal with this by way of a fine.   A fine of $250.00 is accordingly imposed.
