Decision: An information lodged by Stipendiary Steward Mr J Muirhead against Mr B Lee, driver of PARFAIT INVASION, alleging a breach of Rules 869 (4) and (6) (b) and (c), in that Mr Lee improved his horse outwards from the running line

An information lodged by Stipendiary Steward Mr J Muirhead against Mr B Lee, driver of PARFAIT INVASION, alleging a breach of Rules 869 (4) and (6) (b) and (c), in that Mr Lee improved his horse outwards from the running line forcing WHITE SQUALL driven by Mr G Wolfenden and IWI TROUBLE driven by Mr J Abernethy to race wider on the track with approximately 1500m to run.

Mr Lee admitted the breach and did not wish to be present at the hearing.

Stipendiary Steward Mr B Van Kan demonstrated the incident by use of the video film.  PARFAIT INVASION was three back on the running line when Mr Lee moved the horse outwards – at that time WHITE SQUALL was improving outside parfait INVASION and IWI TROUBLE was outside of WHITE SQUALL.  WHITE SQUALL and IWI TROUBLE were forced to race wider on the track around the bend from the back straight to the front straight.

PENALTY :

--

Mr Van Kan suggested a fine of $200.00, he said Mr Lee had no relevant breaches of the Rules recorded against him.  In fixing penalty I took into account the following matters:

--

1.        The guilty plea, although this was a clear breach of the rule.

--

2.        The submissions of Mr Van Kan.

--

3.        Mr Lee’s clear driving record.

--

4.        Two horses were affected by the breach of the rule.

--

5.        The two affected horses were forced to race wider around the bend.

--

6.        The recommended starting point for a breach of this Rule is $250.00.

--

Balancing all of those matters I impose a fine of $250.00.
