The charge having been admitted is accordingly proved.

Penalty:

Taking account of all matters presented to us the Committee imposes a fine of $250.00 on Miss Blakemore.

Charge:

An Information was lodged by Stipendiary Stewart Mr TW Taumanu against Junior Horseman Miss KL Blakemore the Driver of KITTY MAGUIRE alleging that Miss Blakemore drove carelessly when she caused interference when racing into the first bend to DIMA (Driver P Hilliard) when attempting to push DIMA down to the running line.

Miss Blakemore was present at the Hearing and she indicated that she admitted the breach. Miss Blakemore as a Junior Driver was assisted by Senior Horseman Mr J Stormont.

Rule 869(3)(b) provides:

“No Horseman in any race shall drive carelessly.”

Facts:

Mr Taumanu demonstrated the incident by use of the video films which showed Miss Blakemore driving KITTY MAGUIRE on the outside of DIMA racing into the first bend. DIMA was at that stage racing one off the fence. Mr Taumanu said that Miss Blakemore tried to shift DIMA down onto the running line but was unable to do so and then tried a second time and as a result of that caused interference to DIMA. Mr Taumanu said that he was more concerned about the second incident than the first.

Miss Blakemore said that her horse was green. It was only the horse’s second start and she believed that the horse’s greenness contributed to the incident although she did accept that she should have taken more care to keep her horse off Mr Hilliard’s horse.

The films clearly showed the incident.

Submissions for Penalty:

Mr Taumanu referred to the JCA Guidelines. He said that Miss Blakemore was an experienced Junior Driver and he was concerned about the second incident shown on the film and the fact that Miss Blakemore’s horse was running all over the place. He submitted that a fine of $350.00 was appropriate. He also submitted that a suspension of Miss Blakemore’s license for three driving days could be an alternative.

Miss Blakemore and Mr Stormont on her behalf submitted that her horse’s greenness had contributed to the incident and that the penalty submitted by Mr Taumanu was too high. Mr Stormont submitted that a fine might be appropriate because being able to drive in Junior Driver’s Races was important because Junior Drivers do not have a lot of opportunities.

The Committee pointed out to Miss Blakemore that she could not totally rely on the greenness of her horse at the time of the incident because she would have been aware prior to that that it was racing greenly and she should have been on her guard. Miss Blakemore did say that the horse was having its first start for a considerable period of time and that it had not been to the trials.

Reasons for Penalty:

In considering penalty, the Committee had looked at both incidents as demonstrated by Mr Taumanu and had taken note of the fact that he was more concerned with the second attempt by Miss Blakemore rather than the first. Too her credit however, Miss Blakemore has readily admitted the charge and has been quite open when talking about the incident. She is an experienced Junior Driver although perhaps not as experienced as some of her male counterparts in the northern junior ranks. Miss Blakemore has a good driving record and this was readily acknowledged by Mr Taumanu and the Committee notes that Miss Blakemore’s horse was racing somewhat greenly although knowing this she might have been wiser to not race quite so close to Mr Hilliard’s horse.
