As Mr Enyon admitted the breach the charge was found proved.

Penalty:

Mr Eynon is suspended from riding from the close of racing on Sunday September 11th up to and including racing on Friday September 23rd.

Charge:

Following the running of Race 4, the Peter & Colin Wah Maiden Steeplechase, an Information was lodged by Mr R Neal alleging that R Eynon the rider of PAPA DON”T PREACH allowed his mount to shift inwards near the post on the first round when not clear of WHISPER TO ME (C Perrett) which was checked.

Facts:

Mr Goodwin identified the two affected runners in the John Wheeler colours. Mr Eynon was seen to let his mount move inwards on Mr Perrett who in turn crowded another horse to his inside. When questioned by the Stewards Mr Perrett confirmed that Mr Eynon had not been the required distance clear which caused him to take a hold of his mount at that point.
Mr Eynon said that he was unaware of the incident until he watched the video after the race in the Stewards’ room. He said that if Mr Perett had called to him at the time he would have rectified the situation.
 

Submissions for Penalty:

Mr Neal said Mr Eynon rides throughout Australia and New Zealand and had an excellent record with no suspensions this year. The stewards’ opinion was that the interference was at the lower end and their penalty submission was for a two day suspension.

Mr Eynon said that he thought that was a fair penalty.

Reasons for Penalty:

In coming to a decision on penalty the committee considered all of the submissions. It is usual for Judicial Committees to adopt as a starting point a suspension of five days however in this instance we adopted a lower starting point due to Mr Eynon’s status as a jumps and high weight rider which we believe offers him limited opportunities in comparison to a flat rider. We also noted the decreasing number of race days available for Mr Eynon to ride in this jumping season. Taking into account his admission of the breach, his excellent record and the low level of carelessness Mr Eynon was suspended for two riding days.
