CHARGES:

Following the running of race 8, information 65098 was filed by Stipendiary Steward Mr N Goodwin against Ms M Wenn alleging a breach of rule 638(1)(d).  The information stated that “M Wenn permitted her mount DANZINGINTHEDARK to shift out passing the 350m dictating CENTAJ (T Thornton) out into the line of TICKLES which was checked”.

Rule 638(1)(d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”

Ms Wenn indicated the breach of the rule was admitted and also that she understood the charge and the rule it was laid under.

FACTS:

--

Mr Goodwin showed the film of the incident and said at approximately the 350m mark Ms Wenn was attempting to get a run towards the outside fence to obtain the better going (the track was rated a heavy 11) when she moved outwards when not clear of Ms Thornton who was in turn dictated into Mr Bosson who was riding TICKLES. He said Mr Bosson’s rightful line of running was taken as a result of which he was tightened.  Mr Bosson had then had to take hold of his mount and shift inwards before going on to win the race. Mr Goodwin said the careless riding was at the lower of the scale.

Ms Wenn said she had angled out more than she should have.  She said she did straighten up as soon as she realised she was crowding Ms Thornton but she thought she was clear when she was moving across.  She said she was leading the race at the time and so was “dictating to everyone” but conceded she had caused the tightening to Ms Thornton.

SUBMISSIONS ON PENALTY:

Mr Goodwin said the stipendiary stewards considered Mr Wenn to be a North Island rider who occasionally rode in the South Island.  She was a rider who got a lot of rides and had a very good riding record having not breached the careless riding rule since July 2009 when she was suspended for 4 days..  He did not believe the interference was at the top end of the scale and submitted that the stewards believed a penalty of a four day suspension was warranted.

Ms Wenn was invited to make her submissions on penalty.  She advised she had confirmed rides for Matamata on 9 June and that she might be riding at Timaru the following day but should be able to get off the ride were she to be suspended.  She said did not want to seek a deferment of a suspension should he be given one.  To a question from the Committee she confirmed she did not intend riding at Oamaru on Sunday 13 June.

REASONS:

--

In coming to a decision on penalty the Committee has considered the films of the incident, Ms Wenn’s excellent riding record and her admission of the breach.  We agree with the stipendiary stewards that the degree of carelessness is at the low end but nevertheless her actions did cause Ms Thornton to move out into the line of Ms Bosson who was tightened and then had to change his line of running.

PENALTY:

--

The Committee has decided a period of suspension is appropriate in this case and Ms Wenn is suspended from the close of racing on Wednesday 09 June 2010 to the close of racing on Wednesday 16 June 2010.  This is effectively 4 riding days being Timaru (10 June), Avondale (11 June) Te Rapa (12 June ) and Waipa (16 June).  The Committee has not included Oamaru on 13 June as Ms Wenn confirmed she did not intend riding at that meeting.
