Following the running of the last race apprentice rider T Sasada was called to appear before the committee to answer a charge of careless riding
Following the running of the last race apprentice rider T Sasada was called to appear before the committee to answer a charge of careless riding. This relating to an incident that occurred during the running of race 8, the Foxton Business Houses 2000.
--It was alleged that Mr Sasada rode carelessly when he allowed his mount JIHID JIDAAN to shift inward when not clear of VICTORY CROWN (B S Herd), forcing that runner in and onto OAK (G McKeon), who had to check, such occurring in the home straight on the first occasion.
--Mr Sasada who was assisted by his employer Mr D Haworth, denied the breach.
--When presenting his evidence Mr Oatham called on Stipendiary Steward C George to explain the alleged incident by way of the films of the race. In these Mr George demonstrated where he believed Mr Sasada had allowed his mount to move inward, when not the requisite distance clear of VICTORY CROWN dictating its line and compelling it to move down and onto OAK forcing rider McKeon to check out of its rightful position.
--When called to give evidence riders Herd and McKeon both confirmed that their line was dictated from the outside and its was their firm view that this was due to the action of Mr Sasada moving inwards. While Mr Herd stated that contact was not made between his mount and JIHAD JIDAAN, he did however say that it would have had he not elected to shift ground when he did.
--Mr Howarth, when making his submissions on behalf of Mr Sasada, conceded that Mr Sasada had tightened the runners on his inside fractionally however he contended that VICTORY CROWN had been racing erratically at the time of the incident and this had contributed to the resultant checking of OAK.
--DECISION AND REASON.
--It is clear from the committee's view that as the field has approached the winning post on the first occasion that Mr Sasada has been looking to get into a position closer to the rail. However in undertaking the manoeuvre he has allowed his mount to crowd that of Mr Herd, dictate its line, and force it off its intended line of running, the consequence of this being that Mr McKeon has received a check and has lost his position in the race.
--While we acknowledge that VICTORY CROWN may have raced a little erratically in the early stages of the race we find that at the time of the incident that this was not the case.
--We find that the interference suffered by VICTORY CROWN and in particular OAK was as a direct result of Mr Sasada allowing his mount to shift inwards when insufficiently clear and therefore we find the charge proved.
--PENALTY
--When making his penalty submission Mr Oatham presented Mr Sasada's record, which shows no previous breaches of the rules.
--With regard to penalty Mr Oatham submitted that he saw the breach as a moderate one neither near the top nor bottom of the scale. He believed that a term of suspension was appropriate in this case.
--Mr Howarth asked the committee to consider leniency as Mr Sasada had a confirmed book of rides at Riccarton the following Friday.
--The committee, after carefully considering the submissions of Mr Oatham and Mr Howarth, find that the appropriate penalty in this case is a term of suspension. In reaching this determination we find that the incident sits about mid range and as such cannot be dealt with by way of a monetary penalty.
--In determining the quantum to be imposed the committee's has used a starting point of 3 days and to this we have applied the aggravating and mitigating factors.
--The aggravating factors are that Mr Sasada has caused a check to two runners, which in turn has resulted in them losing prominent positions in the race. The mitigating factor is that Mr Sasada has, until today, a clear record.
--Therefore after balancing all factors we find that the appropriate penalty is a suspension of three days.
--Mr Sasada is therefore suspended from the close of racing on Saturday 2nd of September up to and including racing on Saturday 9th September 2006.
