Following the running of Race 8 Ms. L.Cropp lodged an information instigating a protest pursuant to the Rules of Racing alleging that Dunmore Boy or its rider placed 1st by the Judge interfered with the chances of Go Thenaki placed 2nd by the judge.
Following the running of Race 8 Ms. L.Cropp lodged an information instigating a protest pursuant to the Rules of Racing alleging that Dunmore Boy or its rider placed 1st by the Judge interfered with the chances of Go Thenaki placed 2nd by the judge. The interference occurred in the home straight.
--The Judge's placings were, first No 5 Dunmore Boy, second No 1 Go Thenaki, third No 6 Beaudamiss and fourth No 3, Bumper To Bumper.
--The margin between first and second was half a neck.
--The information was filed with the registrar within the time prescribed.
--Present during the hearing were Mr. Hannam, rider of Dunmore Boy, Ms Lisa Cropp, rider of Go Thenaki and Mr J.Donovon representing the connections of GoThenaki. Mr Carson, the trainer and owner of Dunmore Boy did not wish to be present for the inquiry.
--Ms Cropp alleged that Dunmore Boy bumped her mount Go Thenaki twice in the final 150 metres of the race. She asserted that these two incidents cost her mount, with the top weight of 58kgs, the race. Three views of the incident were shown on video and Ms Cropp stated that her horse was put off stride twice by Dunmore Boy and that the winner dictated her rightful line of running.
--Mr Donovon concurred with what Ms Cropp had said.
--Mr Hannam, rider of Dunmore Boy used the films to show Go Thenaki racing all the way down the home straight with his head turned out. He alleged that Go Thenaki ridden by Ms Cropp was laying in on his mount.
--Mr Goodwins submissions to the committee were that Go Thenaki contributed to the incident by shifting inwards at the same time as Dunmore Boy shifted out.
--Decision
--Rule 876 (1) requires us to ask first whether interference occurred and then, if so, whether that interference has cost the horse interfered with a chance of finishing in a better position.
--We are satisfied having viewed the films and listening to the evidence that some interference has occurred. The two horses concerned have made contact but the committee concluded that both horses contributed to the incident and therefore declined to alter the placings. The protest is dismissed and placings are allowed to stand as called by the Judge.
