Following the running of race 5 an information was laid by Stipendiary Steward Mr R Neal under Rule 530 (2) (6) alleging that Mr P Turner, rider of PENSTAR, used his whip in an excessive manner prior to the 200 metres.

--Mr Neal read the relevant rule and defendant Mr P Turner confirmed he understood the rule and that he admitted the charge.
--Mr Neal showed the film of the incident and informed the committee Mr Turner’s mount was struck approximately 13 times continuously without relief. This is well outside the guidelines.
--Mr Turner agreed with Mr Neal that he had breached the guidelines. It looked bad on film and he put it down to a rush of blood and excitement.
--Mr Neal told the committee that Mr Turner had been charged twice under this Rule so far during the jumping season. A breach in July resulted in a fine of $300, and a breach in August at the Grand National meeting resulted in a fine of $500. He believed the offence was in the mid to high range. It looked bad and even though he had been charged twice under the Rule he asked for a monetary penalty of between $400 and $500.

--Mr Turner, this committee, in coming to its decision to impose a monetary penalty for this offence, has taken into account your guilty plea. As an experienced high weight and jumping jockey a rush of blood and excitement is no excuse for what we believe is an offence that lies in the mid to high range. Incidents like this do not look good and the guidelines are there for jockeys to adhere to. We note your record under this Rule, which is not good, but as the jumping season is about completed we were very reluctant to impose a period of disqualification. Mr Turner this committee fines you the sum of $500.
