At the conclusion of Race 1, the Dunedin City Ford Trot, an information was lodged by Mr Allison under 870(4)(a) alleging ZACHARY SMITH, which finished 4th, was in its incorrect gait in excess of 50 metres over the final stages.

Rule 870(4) provides:
Any horse which breaks from its gait in any race and (a) which fails to promptly regain its proper gait … may (in addition to any other penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horse Regulations made by the Board, be placed by the Judicial Committee immediately after any other horse in respect of which any advantage may have been gained.

Mr Allison demonstrated on the videos that ZACHARY SMITH galloped for approximately 80 metres and was still out of its gait when it crossed the line.
Mr Thomas, the junior driver of ZACHARY SMITH, represented the connections and, after being assisted by Mr J Cox, Open Horseman, indicated on the information that he did not contest the protest.
Reasons for Decision:
The Committee is satisfied that ZACHARY SMITH galloped in excess of 50 metres over the final stages. In these circumstances the horse is disqualified.
