Mr Renault alleged that Mr Walkinshaw permitted his horse RAPHOE to start from the incorrect barrier position in race 4.
Mr Renault stated that Mr Walkinshaw had drawn 1 on the unruly and should therefore have started from behind horse 5 or wider. As there was a scratching of horse 4 he should have started behind horse 6, CULLER CODED (Mr Williamson) whereas he had started behind horse 5, HUDSON SULLY (Mr Dunn). Mr Renault emphasised the respondent had not gained any advantage through his error.
Mr Walkinshaw explained he had not realised horse number 4 had been scratched. He accepted he should have been behind CULLER CODED.

Mr Renault produced Mr Walkinshaw’s record for this and last season. He had had over 600 drives in total and had no breaches of this rule. Mr Renault submitted a fine of $200 was appropriate.
