Ms Tomlinson has admitted the breach. We thus find the breach proved.

Facts:
Mr Wallis, Stipendiary Steward, alleged that Ms Tomlinson (SOAPBOX) drove carelessly near the 450 metres when permitting her horse to shift inwards when insufficiently clear of DANNY DEL VITO (R McIlwrick), which broke.
Mr Wallis demonstrated on the videos that the respondent was 4 wide in the back straight and Mr McIlwrick, who suffered the interference, was three wide to her inside. As Ms Tomlinson proceeded forward and endeavoured to cross Mr McIlwrick, she came into contact with him at the point of the bend. The consequence was his horse galloped and lost all chance in the race.
Ms Tomlinson received a punctured tyre. She continued to race 3 wide around the bend and then came down the outside, finishing sixth.
Mr Williamson, who assisted Ms Tomlinson, stated that she had eased as she hit the bend and had she kept going she would have been okay.
Ms Tomlinson said her horse was hanging a little and had previously worn a pole and she did not want to push the horse into the corner. She admitted her error was to have eased before she had fully crossed Mr McIlwrick.
Submissions for Penalty:
Mr Wallis produced Ms Tomlinson’s record, which was clear. He submitted a fine of $350 was appropriate.
Ms Tomlinson stated she preferred a fine to a suspension.
Reasons for Penalty:
We view the breach to be mid range. Ms Tomlinson has miscalculated entering the bend and has cost DANNY DEL VITO, which was racing 3 wide, its chance in the race. She was able to continue to progress 3 wide, but did not finish in a dividend bearing position. We believe no alteration to the $500 JCA starting point is necessary for the seriousness of the breach or the culpability of the respondent.
We give credit of $100 for each of the mitigating factors of the admission of the breach and the respondent’s record, which is excellent. That would take us to a penalty of a fine of $300. However, we give a further discount of $50 for the fact that despite her being a very busy junior driver, having had 142 drives last season and 86 this season, this is the first time Ms Tomlinson has been before the JCA.
