After race 5 Mr Knowles, stipendiary steward, instigated a protest into the 5th placing of MISTER CHIP alleging interference with 150 metres to run in that MISTER CHIP moved outwards checking ANVIL?S WONDER (M Jones) and EVERTON HEIGHTS (C Barron) with both runners breaking and losing their chances. He sought relegation to behind ANVIL?S WONDER which finished 13th. Judge's placings were 14, 19, 7, 10, 9, 20.
--Mr Black indicated he was authorised to represent the connections of MISTER CHIP. Mr Knowles demonstrated on the videos that just after straightening MISTER CHIP moved out when not sufficiently clear checking ANVIL?S WONDER and EVERTON HEIGHTS. He moved into the path of ANVIL?S WONDER causing that horse to be squeezed and eventually to be checked and to break. Mr Jones was called by Mr Knowles and he stated that he was going okay at the 350 metres mark. He attempted to progress behind Mr Hunter's back. He said there was room until Mr Black came out. He yelled out to Mr Black to give him room. He said he had to check his horse and it eventually broke. He said if he been able to maintain his position he would have finished much better. When questioned by Mr Black he agreed that Mr Armour may have come in slightly as well, but he believed most of the movement was from his inside and that was from Mr Black.
--Mr Black acknowledged he had moved out when straightening for the run home but alleged that Mr Armour, who was the outside of Mr Jones, had come in more than he had moved out. He said Mr Armour's horse was laying in on Mr Jones. Mr Knowles in reply said all the movement was from the inside and that Mr Jones was in the gap before Mr Black moved out.
--After viewing the videos and listening to the oral evidence we find that the first movement which resulted in Mr Jones being squeezed was from the inside by Mr Black. We accept Mr Armour's horse was lugging in but we do not believe that that horse deviated from its correct line to such a degree that would satisfy us that it contributed significantly to the incident. Mr Jones' evidence also supports our finding as he indicated he believed the movement was from the horse on his inside, MISTER CHIP.
--In these circumstances we are satisfied that interference was caused to ANVIL?S WONDER and EVERTON HEIGHTS and that the interference was the result of Mr Black moving out when insufficiently clear. The consequence of this interference was that both horses broke and lost all chance. Mr Jones in his evidence was quite clear that he was travelling well prior to the incident and was endeavouring to progress forward. In these circumstances we exercise our discretion and relegate MISTER CHIP to behind ANVIL?S WONDER. Amended placings are 14, 19, 7, 10, 20.
